Terms of Service

These Terms of Service ("Terms") govern your use of Video Engine (the "Service"), operated by ELVTE LLC ("ELVTE", "we", "us"). By creating an account or using the Service, you agree to these Terms and to our Privacy Policy. If you don't agree, please don't use the Service.

1. The Service

Video Engine helps you turn your videos, music and ideas into short vertical videos: clips from longer videos, batches of quote videos, and lyric videos with captions. We may add, change or remove features over time.

2. Your account

You must be at least 18 years old (or the age of majority where you live) to subscribe. Give us accurate information, keep your password safe, and tell us right away at support@elvte.biz if you think someone else has used your account. You're responsible for activity on your account.

3. Subscription, free trial and billing

4. Monthly limits

Each plan includes monthly limits (for example, videos exported, transcription hours and stock backgrounds), shown on your home screen. Limits reset on the 1st of each month and unused amounts don't carry over. We may adjust limits to keep the Service fair and reliable for everyone, and will tell you before reducing them.

5. Your content

You keep all rights to the videos, music, lyrics, text and other material you add ("Your Content") and to the videos you make with it. Your video files are not uploaded to our servers; they stay on your computer. Some features send limited material to our service providers so the feature can work (for example, a video's audio to create captions); see the Privacy Policy. You give us permission to handle Your Content only as needed to run the Service for you.

You're responsible for Your Content. Only use material you own or have permission to use, including music, footage, artwork and anything you pull in from a link. Don't use the Service to infringe anyone's copyright, trademark, privacy or other rights.

6. Footage, quotes and other material we provide

6a. Posting to YouTube

If you connect your YouTube channel, Video Engine posts only the videos you choose, with the details you set. Posting uses YouTube API Services, so you also agree to the YouTube Terms of Service. You're responsible for what you post. You can disconnect anytime from your Account page; see the Privacy Policy for details.

7. Acceptable use

Don't:

We may suspend or close accounts that break these Terms.

8. Our property

The Service, including its software, design, branding and ELVTE Video Library footage, belongs to ELVTE and its licensors. These Terms give you a personal, non-transferable right to use the Service while your account is active.

9. Ending your account

You can cancel your subscription anytime and ask us to delete your account at support@elvte.biz. We may suspend or end your access if you break these Terms or if we stop offering the Service; if we stop offering it, we'll give you reasonable notice. Sections that by their nature should continue (like ownership, disclaimers and limits of liability) survive after your account ends.

10. Disclaimers

The Service is provided "as is" and "as available". To the fullest extent the law allows, we disclaim all warranties, including fitness for a particular purpose and non-infringement. We don't promise the Service will be uninterrupted or error-free, or that your videos will reach any particular audience or result. Keep your own copies of your original files.

11. Limit of liability

To the fullest extent the law allows, ELVTE won't be liable for indirect, incidental, special, consequential or punitive damages, or for lost profits, data or goodwill. Our total liability for any claim about the Service is limited to the amount you paid us in the 12 months before the claim.

12. Indemnity

You agree to defend and hold ELVTE harmless from claims arising out of Your Content or your breach of these Terms, including claims that Your Content infringes someone else's rights.

13. Governing law

These Terms are governed by the laws of the State of California, without regard to its conflict-of-law rules. Any dispute will be handled in the state or federal courts located in Los Angeles County, California, unless the law where you live gives you the right to bring it elsewhere.

14. Changes to these Terms

We may update these Terms. If a change is significant, we'll tell you by email or in the Service before it takes effect. Continuing to use the Service after that means you accept the updated Terms.
